As in the motion for rehearing, it is insisted that the conclusions of fact are incorrectly held in the original opinion, we will state some portions of the evidence more fully. Andres Eomero testified:

“My name is Andres Eomero. I do farm work. In May of this' Year I was seven miles on this side of Eio Medina, working for Ascención Labor. I am acquainted with Francisco Espinoza, the defendant in this case. I had known him a short time in May of this year.
