RAMSEY, Judge.
Appellant was indicted in the District Court of Parker County for the murder of one Will Burrow, alleged to have been committed on the 5th day of July, 1906. The evidence showed that on this day one Charley Lankford at a picnic or celebration near the City of Weatherford, stabbed and killed Burrow with a knife in a controversy with respect to a woman of ill-fame and that appellant was present and engaged in the controversy. On trial appellant was convicted of murder in the second degree and his punishment assessed at five years confinement in the penitentiary. Erom this…
