FORMAN, District Judge.
John Kerry, deceased, brought an action under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51, for damages for injuries sustained by him while in the employ of the defendant as a result of the alleged negligence of the defendant. Before his death his deposition was taken. The present plaintiff, executor of the estate of the deceased, was substituted in the action and the complaint amended. Two causes of action are set forth in the amended complaint, one, to recover damages for pain and suffering, medical expenses and loss of wages sustained by the deceased, and…
