GOODRICH, Circuit Judge.

The plaintiffs brought actions in the Federal Court for the Middle District of Pennsylvania against the defendant to recover damages for injuries sustained in an automobile accident. Mrs. Boyle was a passenger in the defendant’s car at the lime of the accident which occurred while the defendant was operating the vehicle upon the highway in the State of New York. Jurisdiction of the Federal Court was founded upon diversity of citizenship, defendant being a resident of Massachusetts.
