Plaintiff in error was plaintiff below, defendant in error was defendant below; parties will b’e referred to as plaintiff and defendant.

Plaintiff filed his action in the district court of Okmulgee county, Okla., on the 18th day of September, 1922. The action was brought to recover on a promissory note in the sum of $1,500, with interest thereon at the rate of 10 per cent, per annum. On the 23rd day of December, 1922, defendant filed answer in said cause. On February 9, 1923, plaintiff filed reply.
