Submitted on motion of The Ohio Fuel Gas Company, defendant-appellee, for dismissal of the appeal for the reason that the questions of law involved have become moot, as appears from the record, the affidavits of Chauncey I. Weaver and Freeman Eagleson, and the exhibits thereto attached, filed in support of the motion, and by other facts of which the Court may take judicial notice.
