This is a proceeding under article 78 of the Civil Practice Act to compel the Board of Education of the City of New York to grant petitioner additional service credit for purposes of seniority, and thereupon to reinstate her to the position of Teacher of Swimming in the day schools maintained by said Board, together with back salary. The matter was originally referred to an Official Referee by an order of this court, dated August 20, 1942, to hear and report upon the issues of fact raised by the pleadings.
