HEFNER, J,

On July 22, 1931, Allen G. Nichols, plaintiff in error herein, filed a petition in the county court of Pottawatomie county in the matter of the estate of Alexander Wallace, deceased, praying that he be allowed a reasonable attorney’s fee because of services rendered the administratrix in closing the estate. It appears that Mary A. Wallace, administratrix of the estate, entered into an agreement with plaintiff in error to employ him to represent the estate and agreed to pay him, as compensation for his services, a reasonable fee to be allowed by the county court of that county.
