Plaintiffs, who are resident taxpayers of the city of Grand Island, brought this action, to enjoin that city and *289its officials from carrying out an alleged contract for the paving of the streets in paving district No. 59 within the city, and to enjoin the city and its officials from ever paving said district.

The grounds alleged for the injunction were that district No. 59 was never lawfully created; that by reason of the city council’s failure to forthwith proceed with the paving, as provided by section 4084, Comp. St. 1922, the ordinance creating the district became null and void and the…
