COFFEY, Circuit Judge.
Defendant-appellant, DEC International, Inc., appeals the district court’s dismissal of the plaintiff’s federal age discrimination lawsuit without prejudice under Federal Rule of Civil Procedure 41(a)(2). We affirm.

DEC discharged the plaintiff-appellee, Robert J. Kovalic, from its employ on March 17, 1986, when he was 54 years of age and on April 29, 1987, Kovalic brought suit against DEC in the U.S. District Court for the Western District of Wisconsin, alleging that his firing violated the Age Discrimination in Employment Act (ADEA).
