In this action of ejectment the defendant in error was plaintiff and the plaintiffs in error were defendants in the lower court. The theory of the plaintiff is that both parties claim the land sued for from a common source, Ashe-ville H. Smith, and hence it was unnecessary for him to trace title beyond the common grantor.
