Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of the Board of Parole which revoked petitioner’s parole.
Petitioner was convicted of manslaughter in the first degree stemming from the beating death of his father, as well as attempted robbery in the third degree stemming from an incident where the victim was assaulted with a bottle.
