Something might properly be said in elaboration of the rulings in the 1st headnote. This court has several times observed that confusion exists in its decisions with reference to the test for determining former jeopardy. See Ingram v. State, 124 Ga. 448 (52 S. E. 759). The constitution of this State (Code, § 2-108) provides that “no person shall be put in jeopardy of life, or liberty, more than once for the same offense.” This was the *115rule at common law, and the principle has been embodied both in the Federal constitution and the constitutions of the several States of the…
