Plaintiff Citizens for Responsibility and Ethics in Washington brings this action pursuant to the Federal Advisory Committee Act (“FACA”), 5 U.S.C.App. 2 §§ 1 et seq., and the Administrative Procedure Act (“APA”), 5 U.S.C. § 706, against the Department of Health and Human Services (“HHS”) and its Secretary, Michael Leav-itt.
