MEMORANDUM OPINION

This matter came before the Court on plaintiff's motion for summary judgment and claimant's motion to dismiss this action for forfeiture in rem. At the Court's request, the Magistrate Judge prepared a Report and Recommendation which concludes that claimant's motion should be denied and that summary judgment in favor of the plaintiff should be granted. After careful, independent review of the file, including the motion papers, the Court has determined that summary judgment is inappropriate at this moment, and our ultimate decision on the parties' motions will be forestalled.…
