State v. Perrigo
Supreme Judicial Court of Maine
1Opinion of the Court
CLIFFORD, Justice.
The State appeals from an order of the District Court (Belfast, Staples, J.) suppressing the fruits of a search warrant executed at the Searsport home of defendant Jeffrey P. Perrigo, who stands accused in this proceeding of two counts of unlawfully furnishing scheduled drugs, 17-A M.R.SA. § 1106 (1983 & Supp.1993). Because we agree with the State’s contention that the District Court applied the wrong standard in its review of the magistrate’s determination that probable cause existed to search the Perrigo residence, we vacate the District Court’s order.
