In an action to recover damages for personal injuries, arising out of a collision between two automobiles at an intersection controlled by a traffic light, the defendant appeals from an order of the Supreme Court, Suffolk County, entered March 7, 1960, granting plaintiffs’ motion for summary judgment striking out defendant’s answer (Rules Civ. Prac., rule 113). Plaintiff driver, Frank J.
