Memorandum: Plaintiff commenced an action to recover damages for personal injuries sustained when the automobile in which he was a passenger was involved in a one-car accident. Defendant driver admitted that he fell asleep at the wheel. The court directed a verdict for plaintiff on the issue of defendant’s negligence (CPLR 4401) at the close of defendant’s proof.
