This is the second habeas corpus proceeding instituted in this state involving the respective claims of Thelma B. Wren, the mother, and Thomas Francis Wren II, the father, to the custody of their son Thomas Francis Wren III. The boy is their only child, and he is now five years of age.
The first proceeding in this state was instituted by the father in the Superior Court of Alameda County. The present proceeding was instituted by the mother in this court after the superior court had expressly made its orders subject to such disposition as might be made by a higher court.
