OPINION

HUSPENI, Judge.

Appellant the City of Burnsville (Burns-ville) brought breach of contract and negligence actions against respondents Orr-Schelen-Mayeron and Associates (OSM) and Chicago Bridge and Iron Co. (CBI) regarding construction of a water storage standpipe. The trial court directed a verdict against Burnsville on the breach of contract claim and submitted the negligence claim to the jury.
