Affirming.

On January 6, 1930, Hubbard R. Petty, sheriff of Jefferson county, appointed Dan Buecbele, Sr., deputysberiff at a salary of $2,000 a year. On February 1, 1933, Bueehele’s salary was reduced to $1,500 a year for the remaining eleven months of his term.

This action was brought by Buechele against Hubbard R. Petty and the state auditor to recover the difference between what he was paid and what he should have received at the salary fixed at the time of his appointment. Recovery was asked on the ground that the reduction of salary was in…
