This suit involves the construction of an indemnity agreement between Houston Lighting & Power Company (HL & P), and Atchison, Topeka & Santa Fe Railway Company (Santa Fe). The case originated from a Santa Fe employee’s claims against Santa Fe for injuries sustained on the job. Santa Fe joined HL & P as a third-party defendant, claiming the right to indemnity under their indemnity agreement.
