Plaintiff, Lader’s Tiffany Feed and Supply Co., Inc., filed a complaint to have the court determine whether defendant Thomas Kohl’s actions created a debt to Lader’s that is non-dischargeable under 11 U.S.C. § 523(a)(2)(A). Section 523(a)(2)(A) prevents discharge of an individual from any debt “for obtaining money, property, services, or an extension, renewal, or refinance of credit, by — (A) false pretenses, a false representation, or actual fraud.” For a debt to be held nondischargeable because of a false representation or false pretenses, the…
