The state charged the defendant with murder in violation of General Statutes § 53a-54a. The *764jury, after twice deadlocking, found the defendant guilty of the charge. The defendant appeals from the judgment of conviction, alleging that (1) the trial court’s instructions given prior to voir dire violated the defendant’s constitutional rights, (2) the trial court’s “Chip Smith” jury charge pursuant to State v. Smith, 49 Conn. 376 (1881), violated the defendant’s constitutional rights, and (3) the evidence presented at trial was not sufficient to sustain the conviction.
