McGinnis, Judge:

This is an action of assumpsit instituted in the Circuit Court of Fayette County in which the plaintiff seeks to recover the balance which he alleges to be due him for wages as mine foreman of the defendant for the months of November and December, 1921, and January, February, Miarch and April, 1922. From a judgment rendered in favor of the plaintiff upon a verdict of a jury for $240.00 the defendant prosecutes this writ of error.
