This matter is before the court on the parties’ cross-motions for summary judgment and on plaintiffs’ motion for class certification. Plaintiffs Edward and Dorothy Hughes have brought this lawsuit under the Employee Retirement Income Security Act (“ERISA”) alleging that defendant Minnesota Mining and Manufacturing Company (“3M”) implemented changes to the medical benefits provided to eligible retirees in violation of federal law.
