This suit originated before a justice of the peace and found its way, by appeal, to the circuit court, where, after a trial by the court, there was a finding and judgment for the plaintiff, the appellee. The defendant, having been refused a new trial, appealed to this court. He has here assigned the following errors : first, that the judgment of the court is not in accordance with law and is not sustained by the evidence; second, that the cause of action is founded on a claim for money due or loaned, viz., eighty-seven dollars, when there is no evidence that the plaintiff ever loaned or paid…
