RAMSEY, Judge.

Appellant appeals from a conviction of murder in the second degree had in the District Court of Clay County, on December 3, 1908, in which he received sentence of fifteen years imprisonment in the penitentiary.

The record is very voluminous, and the testimony for the most part is circumstantial. The evidence in brief showed that appellant and his wife, Emma Crowell, resided on a farm in Clay County, some six or seven miles from Wichita Falls, and that there was living with them at the time of the death a Miss Lula Smith, who was teaching school near by, their little girl, Thelma…
