This matter comes before the court on defendant’s motion for summary judgment asserted under Rule 56 of the Federal Rules of Civil Procedure, 28 U.S.C.A. The case originally came to this court on defendant’s petition for removal from the District Court of Iowa in and for Pottawattamie County (the county of plaintiff’s residence), on the ground of diversity of citizenship. After answer, defendant, with leave, filed a counterclaim for declaratory judgment and subsequently, with leave granted, joined Mollie Harrill, mother of the plaintiff, also a resident of Pottawattamie…
