MEMORANDUM

JOHNSON, Chief Judge.

On October 4, 1972, this Court held that the failure of the Board of Corrections to afford the basic elements of adequate medical care to inmates in the Alabama Prison System constituted “a willful and intentional violation” of their rights under the Eighth and Fourteenth Amendments. Newman v. Alabama, D.C., 349 F.Supp. 278, 287. Four years later, when the Court issued its order in Pugh v. Locke, D.C., 406 F.Supp. 318 (1976), those same serious shortcomings persisted.
