In an action to recover damages, inter alia, for negligence, the defendant AXA Marine & Aviation Insurance (UK) Limited appeals from an order of *508the Supreme Court, Nassau County (DiNoto, J.), dated February 3, 1995, which denied its motion for summary judgment dismissing the complaint and all cross claims insofar as asserted against it.

Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint and cross claims are dismissed insofar as asserted against AXA Marine & Aviation Insurance (UK) Limited.
