MEMORANDUM AND ORDER

Plaintiff brings this declaratory and mandamus action, arising from the government’s proposed disposal of property known as the Sunflower Army Ammunition Plant in DeSoto, Kansas. Plaintiff asserts rights under the Federally Recognized Indian Tribe List Act of 1994, 25 U.S.C. §§ 479a & 479a-l, the Indian Gaming Regulation Act, 25 U.S.C. § 2701 et seq., the Federal Property and Administrative Services Act, 40 U.S.C. § 471 et seq., the National Environmental Policy Act, 42 U.S.C. § 4331 et seq., and the common law.
