Claiming that he had not recovered from a work-related injury, the plaintiff police officer brought an action in the Superior Court when the defendant chief of police ordered him back to work. The plaintiff had spent all available sick and vacation days and sought sick-leave under G. L. c. 41, § 11 IF. At approximately the same time as bringing his complaint, the plaintiff applied for an accidental disability retirement under G. L. c. 32, § 7(1).
