*633In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Suffolk County (Underwood, J.), dated January 21, 2004, which granted the motion of the defendant Modern Italian Bakery of West Babylon, Inc., for summary judgment dismissing the complaint insofar as asserted against it, and granted the separate motion of the defendants Augustino Moronese and Augie’s Distribution Corp. for summary judgment dismissing the complaint insofar as asserted against them.
