Defendant herein was charged by information with the crime of murder. After a plea of not guilty, be was tried before a jury which returned a verdict of guilty of manslaughter. This appeal is prosecuted from the judgment of conviction, from an order denying a motion for new trial, and from an order denying a hearing on defendant’s application for probation.

There is little controversy as to the facts. They may be summarized briefly as follows: Defendant, aged 22, was a son-in-law of a Mrs. Shook, who was the owner of a mining claim operated under the name of Temeseal Clay Company ; said claim…
