FISHER, Chief Justice.
This is an action of trespass to try title, ’ and was originally brought by Amelia M. Howland and her husband, Thomas A. Howland, to recover an undivided one-half interest in a league and labor of land, situated in Hays County, patented to the heirs ' of David Wilson. In 1896 Mrs. Howland died, when her husband Thomas A. Hbwland and her son Henry Howland made themselves parties plaintiff, and sought to recover as the heirs of Mrs. Amelia How-land.
