It is assigned as error that the court permitted the deed to the land in suit from Henry Akin to J. L. Given, dated the 11th day of July, 1863, to be read in evidence, notwithstanding the objections of appellant. The deed had been “filed, and notice given under the statute. The objection raised was that it had not been duly acknowledged and authenticated for registration.
