On August 19, 1940, appellant filed a complaint in the circuit court of Kankakee county to foreclose a real estate mortgage on certain premises in the city of Kankakee, executed by Hyman Amove and Dora Amove, his wife, dated September 20, 1937, executed October 27, 1937, securing their promissory note of even date for $2,500.
