1. The present demurrer to the plaintiff’s petition, in so far as its grounds are special, comes too late, and in so far as it is a general demurrer the questions sought to be raised are res adjudicata, since the recital in the bill of exceptions when this ease, was formerly before this court shows that the defendant had previously urged an oral general demurrer to the suit, and that such demurrer was then overruled.
