JEit'ror from Douglas District Court. Action by the heirs of Lewis Twining, deceased, upon a policy of insurance'upon the life of said Twining, for $5,000. Trial at the November Term 1872 of the district court, without a jury. ■Findings and judgment for the plaintiffs for $5,225.36. New trial refused, and the Life Insurance Co. brings the case here. The pleadings, proceedings and evidence are folly stated in the opinion, infra.

This was an action on a life-insurance policy. The petition in the court below, after the title, reads as follows:

“Edward E. Twining and Emma A. Twining, infants, (who prosecute by their next friend Moses McMillan,) and Mary E. Twining, plaintiffs, show to the court that the defendant is a corporation, created by and under the laws of the state of Missouri, and having an office, and doing business within the state of Kansas, and duly empowered by law to do the business of life insurance within said state of Kansas: That on the 15th of…
