This case comes to this court for review by virtue of section 75 of chapter 110, Be vised Statutes, 1901, and the sole question certified up for our decision is, whether the instrument hereafter quoted is a chattel mortgage or a conditional sale.
The case was tried in the first instance before a jury; the action was replevin, with a trover count, under which count appellee recovered a judgment against appellants for the sum of $260.41.
