In this Memorandum Opinion, the Court will further explain and supplement its rulings announced from the bench at an evidentiary hearing held in the above-captioned class actions on October 5 through 7, 1983. The purpose of that hearing was to determine whether a massive telephone campaign in which Defendant solicited exclusion requests from about 4,000 prospective class members was improper and if so, (1) whether the extent of the improprieties justify remedial action or imposition of penalties against Defendant; (2) whether the involvement of the Bank’s…
