Tolub, J.), entered July 25, 2005, which, to the extent appealed from as limited by the briefs, granted defendants’ pre-answer motion to dismiss plaintiffs first cause of action, alleging legal malpractice, for failure to state a cause of action, unanimously reversed, on the law, without costs, the motion denied and the first cause of action reinstated.
