The appellant and two other persons were jointly indicted, in this case, by the grand jury of the Daviess Circuit Court, at its March term, 1878.

The indictment contained but one count, in which it was charged, in substance, that the appellant, “one Jamos F. Peachee, one John Doherty and one Harry Faulkner, late of said county, on the 15th day of October, A. D. 1877, at said county and State, did then and there unlawfully, feloniously, wilfully and knowingly, send to one Joseph Cabel. a certain letter and written communication, signed with a fictitious name, to wit, ‘Vengeance,’ directed to…
