The appellee, as plaintiff, sued the appellants, as defendants, in the court below.
In his complaint, the appellee alleged, in substance, that on the 29th day of July, 1868, the appellants, by their written agreement, a copy of which was filed with and made part of said complaint, sold, and agreed to sell, to appellee, three hundred head of good corn-fed hogs, spade sows, and harrows, to average two hundred and fifty pounds gross, to he delivered in Cincinnati, Ohio, from the 15th to the 20th days of December then next ensuing, at the cash price for such hogs on the day of delivery, and agreed…
