Supersedeas to a judgment of the municipal court of Wheeling, rendered on the 28th day of August, 1871, allowed on the petition of the West Virginia Insurance Company — the defendant below. The plaintiff was James IT. Simmons. The other facts appear in the opinion of the Court. The Hon. M. C. Good, judge of said municipal court, presided at the trial below.

This is an action of assumpsit founded on a policy of insurance made by the defendant to the plaintiff on the 6th day of January, 1870. The policy insures the plaintiff against loss or damage by fire to the amount of $2,-600 on his stock of dry goods, groceries, queensware, hats, caps, boots and shoes, and such other articles of merchandise as are usually kept in a country store, all contained in the one story frame building situate on the south side of State street, in the town of Portland, Preston county, West Virginia, and occupied by assured as a store room, subject…
