MEMORANDUM AND ORDER Re: Trustee’s Objection to Exemption

The matter before the Court is the Trustee’s Objection to Property Claimed as Exempt. The Trustee is attempting to reach the Debtor’s interest in annuity contracts. The Debtor contends that the annuities constitute “spendthrift trusts” under applicable nonbankruptcy law, and therefore should be excluded from the bankruptcy estate pursuant to 11 U.S.C. § 541(c)(2).
