1. This action was commenced September 22, 1896, to set aside the contract between the railway-company and the county, whereby the latter agreed to aid the railway company to the extent of $240,000, in bonds of $1,000 each, in exchange for a corresponding amount of stock in the company, and to restrain the delivery of the 'bonds issued and held in escrow therefor, on the ground that the aid so voted was in excess of the constitutional limitation.
