Statement of the Case.
MONROE, J.
Upon March 26, 1902, the plaintiff, as receiver of the Monroe Waterworks & Light Company, instituted this suit, claiming from the city of Monroe the sum of $4,743.35 as a balance due for water and light furnished under contracts by said company prior to January 1, 1902, after deducting all credits to which the city was entitled up to the date of the filing of the suit.
