OPINION AND ORDER

On October 3, 2013, petitioner Kevin Treanor (“petitioner” or “Treanor”) brought this action pursuant to the Limitation of Liability Act, 46 U.S.C. §§ 30501-30512 seeking exoneration or limitation of liability for the July 4, 2012 capsizing of his recreation vessel, the Kandi Won. On December 20, 2013, claimant Paul Gaines (Gaines) filed an answer and counterclaims seeking compensatory damages as executor and administrator of daughter Victoria Gaines, who drowned when the Kandi Won capsized, and as guardian for his minor son, Ryan Gaines.
